Rationale and Purpose
J Ventures Co., Ltd. (hereinafter referred to as the "Company") places the utmost importance on the protection of personal data that users of its services (hereinafter referred to as "Users") entrust and disclose to the Company.
This Personal Data Protection Policy is a policy to which the Company strictly adheres in safeguarding personal data, so as to assure Users of their privacy with respect to the collection, use, or disclosure of their personal data, and to ensure that such protection is effective and in compliance with the Personal Data Protection Act B.E. 2562 (2019). Furthermore, in order to inform and ensure that Users understand the Company's personal data protection practices, the Company has established this Personal Data Protection Policy, which comprises nine (9) chapters, as follows:
Chapter 1: Definitions
"Personal Data" means any information relating to a natural person that enables the identification of such person, whether directly or indirectly, but does not include information pertaining solely to the name, title, place of work, or business address of such person, nor information specific to deceased persons.
"Sensitive Personal Data" means personal data pertaining to racial or ethnic origin, political opinions, beliefs in sects, religions, or philosophies, sexual behavior, criminal records, or any other data of a similar nature as prescribed by law that may affect the data subject in the same manner. The Company shall collect, use, and/or disclose Sensitive Personal Data only upon receipt of explicit consent from the User, or where the Company is permitted or required to do so under applicable law. In addition, the Company may be required to collect, use, and/or disclose biometric personal data — including but not limited to facial image data, fingerprint data, iris data, and voice identity data — for the purposes of verifying and authenticating the identity of Users who apply for and/or conduct transactions through various channels.
"Processing of Personal Data" means any operation carried out by the Company on a User's personal data, including but not limited to the collection, compilation, use, disclosure, and deletion of personal data.
"Data Controller" means the Company, which acts as the data controller for all Users' personal data, and accordingly bears the duties and responsibilities for the processing and security of such personal data. Processing of personal data shall be carried out only to the extent necessary for the provision of services or the disclosure of information required to fulfill a User's request, which may include, as applicable, sales promotion and marketing activities, for purposes, within the scope, and by the means prescribed by law.
"Data Processor" means an entity that collects, uses, or discloses personal data pursuant to the instructions of, or on behalf of, the Data Controller, for the purposes, within the scope, and by the means prescribed by law.
"Customer Database" means the dataset relating to Users that Users have provided to the Company and that the Company retains for the benefit of service provision.
"Company" means J Ventures Co., Ltd. (บริษัท เจ เวนเจอร์ส จำกัด).
"Social Network" means public information transmission and reception services — such as Facebook, LINE, Twitter, and the like — that are supported by the Company.
Chapter 2: User Consent Agreement
The Company may collect information about Users in various forms, including personal data processed in accordance with the practices set out in this Policy. "Personal Data" is information that enables other persons to identify or contact a User — for example, name, address, telephone number, and electronic mail address — as well as any non-public information about a User that is associated with or linked to any such information. The Company shall process Users' personal data in accordance with the principles set out under applicable personal data protection law, and solely to the extent necessary for the provision of services to Users.
The Company shall collect, use, and/or disclose Users' personal data in the following circumstances:
- Where the User has given consent, in cases where consent is required by law — such as the processing of Sensitive Personal Data, or processing for purposes beyond the scope of the primary services provided;
- Where processing is necessary for the performance of a contract to which the User is a party, or in order to take steps at the User's request prior to entering into a contract — such as service registration, identity verification, and the creation and administration of user accounts;
- Where processing is necessary for the purposes of the legitimate interests pursued by the Company — such as system administration, security maintenance, fraud prevention and detection, or service quality improvement — provided that such processing does not override the fundamental rights and freedoms of the data subject;
- Where processing is necessary to respond to complaints or to facilitate the exercise of Users' rights in connection with the Company's services;
- Where processing is necessary to comply with applicable laws, legal obligations, or orders issued by any competent governmental authority having jurisdiction over the Company.
In the circumstances described in Chapter 2 above, a User may withdraw consent at any time by expressing such intention in the manner described herein. Such withdrawal shall not affect the lawfulness of any processing carried out prior to the withdrawal. Should a User disagree with the Company's use of their personal data pursuant to this Policy, the User may choose to discontinue use of the Company's services.
In addition, the Company may transfer the User's personal data to external entities or persons acting as "Data Processors" on the Company's behalf.
Chapter 3: Personal Data Collection Processes
3.1 Data Provided Directly by the User
In general, the Company receives information submitted by Users through application forms during the course of a User's relationship with the Company. The Company collects Users' information when a User registers for or subscribes to any of the Company's services, submits instructions, accesses and uses the Company's online services, clicks on any link appearing in any of the Company's advertisements, requests information or customer support, provides feedback following use of services, or responds to surveys. It may be a condition that Users provide their personal data to the Company in order to enable the Company to manage its operations, maintain a good relationship with Users, and provide appropriate products and services in accordance with applicable laws and the Company's policies. Should a User fail to comply with these requirements or to provide personal data to the Company, the Company may be unable to continue providing products or services to such User.
3.2 Data Received from Third-Party Sources
The Company may receive information that is publicly available or that may be lawfully disclosed, such as information obtained from companies, credit reference agencies, or social media. The Company may receive such personal data from third-party companies that offer products, brands, or personal websites providing the Company's goods and/or services jointly with the Company. Such third parties are legally entitled to provide Users' personal data to the Company. The Company may supplement this information with data already held in its existing databases, obtained through the Company's website, for the purpose of improving the quality of its services.
3.3 Data Collected via the Website
In order to access certain features and options, a User may be required to log in using Facebook or another social network. By logging in, the User authorizes the relevant services to access their information and agrees to the terms of use of the applicable social network. If the User is not yet registered and clicks "Register" or "Sign In" through a social network supported by the Company, the User will be prompted to provide personal data, which will be stored in the social network's database. The User may choose whether or not to register. In such cases, the Company may receive the relevant personal data from the social network in order to facilitate the creation of a user account on the Company's website and to display the Company's content to the User's social network connections. Any data the Company collects from a User's social network account may depend on the User's privacy settings on that social network, over which the Company has no control and for which it bears no responsibility. Accordingly, Users are advised to carefully review the privacy practices and data policies of the relevant social networks.
3.4 Data Collected through Technology
The Company may use cookies ("Cookies") to enhance Users' browsing experience. Cookies are small pieces of data sent by websites to a User's computer hard drive while the User is browsing. The Company may use both session cookies (which expire immediately upon the User closing their browser) and persistent cookies (which remain on the User's computer until deleted) in order to provide personalized and interactive experiences on the Company's websites. Such data is collected to make the Company's websites more functional and user-friendly. If a User wishes to disable cookies, the User may configure their browser settings to reject or block them. However, doing so may result in the User being unable to fully access certain features of the Company's websites.

Chapter 5: Disclosure of Personal Data
5.1 The User agrees and consents to the Company contacting and collecting the User's personal data and service usage information, and further consents to the Company transmitting, transferring, using, and/or disclosing such personal data to the Company's auditors, external examiners, financial institutions, and competent governmental authorities, and/or for the purpose of investigating potentially fraudulent transactions, and/or for any other purpose not prohibited by law, and/or for the purpose of complying with any laws or regulations of any jurisdiction applicable to the Company, and/or for any other purpose necessary to the Company's services.
5.2 The User acknowledges that any records, evidence, or documents created by the Company as a result of the User's use of services are accurate and shall not require verification or signature by the User, and may serve as valid evidence for the purpose of proving any indebtedness, debits, transfers of funds, and/or use of any services, regardless of whether such information is stored and/or compiled in electronic form or any other format. The User is entitled to receive documentary evidence pertaining to the User's transactions.
5.3 With respect to the User's personal data and its disclosure to service providers, the User agrees and consents to voluntarily disclosing their personal data — including but not limited to name, date of birth, address, and details necessary for billing and the receipt of facilitation services — to the Company and external service providers, including such providers' employees and/or agents, for the purposes of application services and facilitation services. Prior to any such disclosure, the Company shall require external service providers to enter into a data processing agreement with the Company, obligating those providers to handle the User's personal data in a manner consistent with the Company's Personal Data Protection Policy as notified to the User, and to implement personal data protection measures in accordance with the Company's standards.
5.4 Governing Law
This Terms and Conditions shall be interpreted and governed by the laws of the Kingdom of Thailand.
5.5 Severability
If any provision, condition, or term of this Policy is held to be void, invalid, unlawful, or unenforceable for any reason, such provision, condition, or term shall be deemed severable from the remaining provisions, conditions, and terms of this Policy, and the remaining provisions shall continue in full force and effect.
5.6 The Company may update or amend this Personal Data Protection Policy without prior notice to Users. The User's continued use of the Company's services shall constitute the User's complete and irrevocable acceptance of the amended or supplemented terms and conditions. Users are advised to review the Terms and Conditions regularly during use of the services, as separate notification of any amendments may not be provided. Such updates may be made as appropriate to improve service efficiency and to reflect changes in applicable law.
Chapter 6: Location Data
If a User has enabled location services on their device, the Company may collect the User's location data in order to enable map functionality for message recipients, thereby displaying the User's location to such recipients. If the User does not wish for this information to be collected, the User may disable location services in the settings of their mobile device.
Chapter 7: Retention Period for Personal Data
The Company shall retain Users' personal data only for the duration of the User's account relationship with the Company, or for as long as necessary to provide services to the User. Where there are reasonable grounds for retention in order to comply with applicable laws, regulations, rules, or internal policy requirements, the Company may retain a User's personal data for the requisite period.
Chapter 8: Data Security
The Company is committed to protecting and safeguarding Users' personal data, and shall implement and maintain appropriate technical and organizational measures to ensure a level of security appropriate to the protection of Users' personal data against accidental or unauthorized destruction, loss, alteration, disclosure, or access. Notwithstanding the foregoing, no transmission of data over the Internet can be guaranteed to be completely secure. Should a User have reason to believe that their interaction with the Company is no longer secure (for example, if the User believes that the security of any account held with the Company may have been compromised), the User should notify the Company immediately using the contact information provided in Chapter 10 below.
8.1 Rights of Users
Under various circumstances, Users may exercise the following rights in connection with the Company's processing of their personal data:
- The right to obtain confirmation as to whether the User's personal data and supplementary information are being processed and assessed;
- The right to request rectification of inaccurate personal data;
- The right to request erasure of personal data and to restrict any processing of such data;
- The right to restriction of processing;
- The right to data portability;
- The right to object to the processing of personal data;
- The right to withdraw consent from electronic mail communications and marketing.
8.2 Should a User wish to exercise any of the above rights, please contact the Company using the contact information provided below. The Company may request that the User provide proof and verification of identity by submitting a copy of a valid identification document or other acceptable evidence of identity, in order to comply with the Company's security requirements and to prevent unauthorized disclosure of information.
8.3 If a User does not wish to accept cookies from the Company's services for any of the purposes described above, the User may manage their browser settings to stop accepting cookies or to prompt notification prior to accepting cookies from websites visited. Users are advised to refer to the technical documentation for their respective browsers. Please note that declining cookies may result in the User being unable to access some or all of the Company's service features. Should a User have questions regarding the disabling or modification of cookies, please contact the Company using the contact information provided below.
8.4 A User may stop all data collection by the Company's applications by uninstalling such applications, using the standard uninstall procedures available on the User's mobile device or through the relevant application marketplace or network. For the purpose of serving in-application advertisements where cookie technology is not available, the Company may reuse the User's device identifier. The User may choose to reset or opt out of this.
Chapter 9: International Transfer of Personal Data
The Company may be required to transfer a User's personal data to foreign countries for the purpose of providing system, technology, or operational services in connection with the Company's services. In doing so, the Company shall ensure that such transfer is carried out in compliance with the Personal Data Protection Act B.E. 2562 (2019), and shall implement appropriate personal data protection measures to ensure that the User's personal data is adequately protected in accordance with applicable law.
